TERMS AND CONDITIONS

1. Definitions

  1. General Terms and Conditions: The general terms and conditions used by Studio Balance, which have been published at the Website.

  2. Studio Balance: Studio Balance BV, which has its official seat at Rijnstraat 63H, 1079GW Amsterdam and is listed in the Trade Register under number 82124957.

  3. Drop In Class: a singly entry for a Class as referred to in Clause 3

  4. Three Class Introductory Offer: three introductory classes as referred to in Clause 3

  5. 10/20/50/Student Class Card: a 10/20/50/Student Class Card, as referred to in Clause 3.

  6. Membership: an Unlimited Monthly Membership or an Unlimited Yearly Membership referred to in Clause 3 for attending Classes, issued or to be issued by Studio Balance and paid or to be paid by the Student.

  7. Class: a yoga, pilates, barre, essentrics or similar class at Studio Balance to be attended and paid by the Student, irrespective of the duration.

  8. Student: a person who attends and/or wishes to attend Classes at Studio Balance.

  9. Website: the website of Studio Balance: www.studiobalance.nl

2. Scope of Application

  1. The General Terms and Conditions apply to any Membership and, where applicable, any Drop In Class, 10/20/50/Student Class Card and Three Class Introductory Offer of and at Studio Balance.

  2. By participating in a Class of Studio Balance, the Student agrees to the applicability of these General Terms and Conditions.

  3. Studio Balance may from time to time amend these General Terms and Conditions. The most recent version of the Terms and Conditions is always the version that is applicable and is always available at the Website. Studio Balance will announce any amendments to the General Terms and Conditions in advance by email.

​​3. Monthly Unlimited Membership, Unlimited Yearly Membership, Drop In Class 10/20/50/Student Class Card and Three Class Introductory. Studio Balance offers the following possibilities of attending Classes at Studio Balance:
 

  1. UNLIMITED MONTHLY MEMBERSHIP AND UNLIMITED YEARLY MEMBERSHIP

  2. The Unlimited Monthly Membership and Unlimited Yearly Membership entitles the member to an unlimited number of Classes during the term of the Membership.

  3. The minimum Membership term for the Unlimited Monthly Membership is one (1) month. After the first month, a Student’s Unlimited Monthly Membership is tacitly converted into a continuing agreement for an indefinite period. The minimum Membership term for the Unlimited Yearly Membership is twelve (12) consecutive calendar months. After the twelve months, a Student’s Membership will be tacitly converted into an Unlimited Monthly Membership for an indefinite period.

  4. The Membership commences either on the agreed starting date or on the day the first payment is made by IDEAL or Credit Card. The next monthly cycles will be paid by direct debit, until termination.

  5. After the minimum term of one (1) month, a Student’s Unlimited Monthly Membership may be terminated every month. Membership must be cancelled prior to the individual renewal date in order to end membership charges. Cancellation of Unlimited Monthly Membership must be processed by the Student through the Website. Studio Balance will not reimburse the Student for the remainder of any paid subscription period, nor will reimbursements be made for membership cancellations prior to any renewal date.

  6. A Student may use any Membership only in the event of payment by direct debit (monthly Membership only).

  7. The Membership fee will be debited from the Student’s bank account around the twentysecond  day of each month. If the Membership starts during the month (i.e. not on the first day of a month), the Membership fee for the first month will be calculated on  the basis of dividing the Membership fee by the days in that month, multiplied by the remaining days in that month counted from the start of the Membership. In case Studio Balance is unable to collect the Membership fee on the first collection moment, Studio Balance will send the student a notification by email informing the student that the collection of the monthly membership payment has failed. There will be a second collection moment around ten (10) days from the aforementioned notification. In case Studio Balance remains unable to collect the Membership fee with the second collection moment, an administration fee of €25 will be charged without prior notice. If the payment has not been made through no fault of the Student, no administration fee will be charged.

  8. A Student’s Membership commences when Studio Balance has received the membership fee from the Student.

    2. DROP IN CLASS

  9. The Drop In Class entitles the Student to one (1) Class.

  10. The Drop In Class is valid for one (1) month from the date of purchase. The 1 Class must therefore be attended within one (1) month of the date of purchase. After that period this right lapses.

    3. THREE CLASS INTRODUCTORY OFFER

  11. The Three Class Introductory Offer entitles the Student to three (3) Classes and can be purchased only once by new Students. A new Student may use the Three Class Introductory Offer only if he or she has not already attended more than one (1) Classes at Studio Balance.

  12. The Three Class Introductory Offer is valid for fourteen (14) days from the first registered class date. The three (3) classes must therefore be attended within fourteen (14) days of the date of the first registered class. After that period, this right lapses.

    4. 10 CLASS CARD

  13. The 10 Class Card entitles the Student to ten (10) Classes and can be purchased an unlimited number of times by a Student.

  14. The 10 Class Card is valid for ninety (90) days from the first registered class date. The ten (10) classes must therefore be attended within ninety (90) days of the date of the first registered class. After that period, this right lapses.

       5. 20 CLASS CARD

15. The 20 Class Card entitles the Student to twenty (20) Classes and can be purchased an unlimited number of times by a         Student.

16. The 20 Class Card is valid for one hunderd eighty (180) days from the first registered class date. The twenty (20) classes must therefore be attended within one hunderd eighty (180) days of the date of the first registered class. After that period, this right lapses.

       6. 50 CLASS CARD

17. The 50 Class Card entitles the Student to fifty (50) Classes and can be purchased an unlimited number of times by a         Student.

18. The 50 Class Card is valid for one (1) year from the first registered class date. The fifty (50) classes must therefore be attended within one (1) year of the date of the first registered class. After that period, this right lapses.

       7. STUDENT CLASS CARD

19. The Student Class Card entitles the Student that is studying at a university or other place of higher education to ten (10) Classes and can be purchased an unlimited number of times by a Student.

20. The Student Class Card is valid for ninety (90) days from the first registered class date. The ten (10) classes must therefore be attended within ninety (90) days of the date of the first registered class. After that period, this right lapses.

 4. Payment and Price Changes

  1. All Classes organized by Studio Balance must be paid for before they are held either via the Website or at the reception desk of Studio Balance. Studio Balance does not accept cash payments. Payments can be made by direct debit (Memberships only), PIN, Credit Card (Visa, Master Card) and Ideal.

  2. As a general rule, direct debits for memberships are made monthly around the twenty-second day of the month. If the amount cannot be collected, a handling fee of €25 is charged. In the case of non-payment, Studio Balance reserves the right to suspend the account of the relevant Student after one (1) month of overdue payment.

  3. Studio Balance reserves the right to change the pricing of all Classes. Any changes are announced in advance either by putting up posters on the premises of Studio Balance, by placing statements on the Website, and/or by email. The currently applicable rates are always mentioned on the Website and are available for inspection/at request at the reception desk of Studio Balance.

  4. Before joining a Class, the Student must check in at the reception desk of Studio Balance. After Studio Balance has verified the registration and payment for the relevant Class, the Student is allowed to enter the Class.

5. Reservations and cancellations for Classes

  1. All Classes are available for online booking 7 days in advance.

  2. A Student can only book Classes online or at Studio Balance’s reception desk.

  3. A confirmed booking is valid until 5 minutes before the Class starts. If the Student has not checked in by then, the booking expires and the reserved spot will become available to another Student.

  4. When a class is fully booked, the Student can sign up for the waiting list. If a spot opens up, Students on the waiting list will receive a push notification via the Eversports App if installed on the Student’s mobile device, no email notification will be sent.

  5. Students can cancel their booking until twelve (12) hours before the Class starts. The Student can only cancel through the Website or the Eversports App.

  6. If the Student cancels within twelve hours before the beginning of the class, this will be noted as a "Late Cancel". Up to three (3) Late Cancels are allowed. If the limit of three Late Cancels is exceeded, Studio Balance will reserve itself the right to suspend the possibility to book online for one month for this particular Student.

  7. If you have a Drop In Class, 10/20/50/Student Class Card, Monthly Membership or Three Class Introductory and you do not show up to this class or do not cancel it up until twelve (12) hours in advance, this Class will be charged.

6. Schedule

  1. The current schedule is mentioned on the Website. Studio Balance reserves the right to change the schedule at any time. If possible, any changes are announced in advance by either putting up posters in the Studio Balance rooms, mentioning them on the Website and/or by email.

  2. Studio Balance reserves the right to cancel a Class that has been scheduled or to change the teacher mentioned in the schedule in the event of force majeure, including illness of the teacher. In the case of replacement of a teacher, there will be no refund of any payment for that Class or relevant Membership.

  3. Studio Balance reserves the right to close its doors on public holidays or on other days, or when imposed by the government, in case of force majeure, national safety or a pandemic.

7. Early Termination of Membership in case of illness

  1. In the event of prolonged illness or an injury, the Student may request to terminate the Membership early. A request for early termination must be submitted to Studio Balance in writing and Studio Balance reserves the right to evaluate and handle each case individually. This request for termination may be sent by email to hello@studiobalance.nl.

8. Liability

  1. Attending Classes and leaving belongings in the changing rooms or at the Studio Balance premises are at the Student’s own risk. Studio Balance accepts no liability for loss or damage of personal belongings of a Student attending Classes and leaving belongings in the changing rooms or at the Studio Balance premises. If during a Class, the Student causes loss or damage to the property of Studio Balance, the student will be held liable.

  2. Studio Balance is not in any way liable for personal injuries sustained during Classes. Participating is always at the own risk of the Student.

  3. Studio Balance provides the following guidelines for reducing the risk of an injury:

    1. Always consult a doctor before starting Classes if you are not sure that you are completely healthy or if you are pregnant.

    2. If you have an injury or any other physical inconvenience, always inform your teacher about this before starting the Class.

    3. Listen to and follow the instructions of the relevant teacher.

    4. Perform the exercises carefully and bear your physical limitations in mind.

    5. Do not perform any exercises that are painful.

    6. Ask questions if you do not understand an exercise.

    7. Avoid inverted poses during menstruation.

  4. Although we strive to only provide correct information on our Website, we are not liable for any inaccuracy and no rights can be derived therefrom.

9. Personal Data

  1. Studio Balance collects personal data of the Students to update its membership records, to execute payment orders and for administration and information purposes. Studio Balance handles this collection of personal data with due care and complies with the provisions of the Dutch Data Protection Act.

  2. Studio Balance uses the personal data referred to in Clause 9.1 to inform the about activities of Studio Balance and any changes in the schedule, for example. If the Student does not want to receive communications from Studio Balance, he or she may unsubscribe from the mailing in the bottom of a received newsletter or communicate this to Studio Balance by sending an email to hello@studiobalance.nl. The Student is aware (s)he cannot use all online services and products of Studio Balance in that case.

  3. Studio Balance never gives any personal data of the Students to third parties without their prior written consent.

10. Governing Law and Dispute Settlement

  1. The General Terms and Conditions are exclusively governed by Dutch law.

  2. Any disputes relating to the General Terms and Conditions, any Membership, a Drop In Class, a Three Class Introductory Offer, a 10/20/50/Student or a Student’s attending Classes organized by Studio Balance are settled exclusively by the competent court in Amsterdam or any higher court.

11. Code of Conduct

  1. Students shall adhere to Studio Balance’s code of conduct at all times:

    1. Please make sure you are clean and fresh when you attend the Class. The use of unscented deodorant is highly appreciated. In view of potential allergies of other Students, everyone is asked not to wear any perfume, aromatherapy oils or other scented products, and not to use any scented spray deodorant in the changing rooms.

    2. Wear clean clothes in Classes, in which you can move easily.

    3. Studio Balance advises not to eat later than two hours before the start of the Class and, in any case, not to attend a Class on a full stomach.

    4. Please do not wear shoes inside the Studio Balance classroom.

    5. Locker keys must always be placed back into the key holder after using said locker. A Student will be charged 25 euros for the loss of a locker key.

    6. We ask Students to clean yoga mats and other props thoroughly after the Class by the Student who has used it.

    7. To allow everybody to find perfect inner peace, Students are requested not to talk in the Studio Balance classroom before, during and after the Class and to talk quietly in the other rooms.

    8. The physical and mental integrity of Students must always be respected. Sexual behaviour or sexually suggestive behaviour is not tolerated by Studio Balance.

    9. Studio Balance reserves the right to deny Students who do not observe the code of conduct referred to in Clause 11.1, to deny access to the Studio Balance premises and to terminate the Membership of the relevant Student without a refund of any membership fee paid already.
